Accounts
You must provide accurate information, keep your login secure and promptly tell us if you believe your account has been compromised. The account owner is responsible for activity carried out through authorised users of the account.
Event Organiser responsibilities
Event Organisers are responsible for their event, stream, programme content, pricing, descriptions, rights and permissions, and for ensuring they have authority to broadcast all video, audio, music, branding and other material they provide. You must not use POWERPPV for unlawful, infringing, fraudulent, abusive or harmful content or activity.
Payment-management choices and commission
POWERPPV offers two payment-management routes. Under self-managed payments, the Event Organiser connects its own Stripe account, manages its own customer payments, payouts, refunds and disputes, and POWERPPV charges a 10% commission on applicable sales unless otherwise agreed.
Under POWERPPV-managed payments, POWERPPV manages customer payment administration, refunds and Event Organiser withdrawals and charges a 15% commission on applicable sales unless otherwise agreed.
Payment-processing fees and other clearly disclosed third-party transaction costs are separate from POWERPPV's commission unless expressly stated otherwise.
Payouts and withdrawals
For POWERPPV-managed payments, eligible organiser earnings become available through the applicable POWERPPV settlement/withdrawal process, subject to payment settlement, fraud checks, refunds, disputes, chargebacks, reserves and legal requirements. Any advertised withdrawal timeframe describes the normal service target and is not a guarantee where funds are delayed, reversed, investigated or unavailable.
For self-managed Stripe payments, payout timing and availability are controlled through the organiser's Stripe account and are subject to Stripe's applicable requirements.
Refunds, disputes and chargebacks
For self-managed payments, the Event Organiser is responsible for managing customer refunds and disputes through its connected payment account. For POWERPPV-managed payments, POWERPPV administers refunds and payment disputes relating to the managed route, but may recover or deduct amounts associated with refunds, disputes, chargebacks, fraud or payment reversals from amounts otherwise due to the Event Organiser.
Streaming service
We aim to provide a reliable streaming platform but live broadcasting depends on internet connectivity, encoders, third-party infrastructure and other systems outside our direct control. Event Organisers are responsible for providing a suitable live feed and testing their broadcast setup. We may suspend or restrict a stream where reasonably necessary for security, legal compliance, platform stability or breach of these terms.
Intellectual property
Event Organisers retain rights they hold in their event content. You grant POWERPPV the permissions reasonably necessary to ingest, encode, transmit, store, display and otherwise process that content to provide the service and any features you choose, such as replay/VOD, embedded playback or highlights.
POWERPPV branding, software, website design and platform technology remain the property of their respective owners and may not be copied or exploited except as permitted by law or these terms.
Customer and personal data
Each party must comply with applicable data-protection law. Where POWERPPV processes personal data solely on an Event Organiser's behalf, the Data Processing Terms published by POWERPPV form part of these terms. Event Organisers must provide lawful instructions and must not instruct POWERPPV to process personal data unlawfully.
Availability and changes
We may update, maintain, improve or change the service. Planned or emergency maintenance and third-party outages may affect availability. We will not deliberately remove paid core functionality without considering affected customers, but individual features may evolve as the platform develops.
Suspension and termination
We may suspend or terminate access where an account seriously or repeatedly breaches these terms, creates a security or fraud risk, fails required verification, does not pay amounts due, infringes rights, or where suspension is reasonably required by law or a payment/technology provider. You may stop using the service at any time, subject to outstanding events, transactions, refunds, disputes and legal retention requirements.
Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that, POWERPPV is not responsible for losses caused by matters outside its reasonable control, an Event Organiser's equipment/feed, unlawful organiser content, or an organiser's own acts or omissions. Any further financial limitation of liability should be confirmed by legal review before these terms are relied on commercially.
Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply to a consumer in their place of residence.
